flugs iranischer und irakischer Streitkräfte durch die Straße von Hormuz seitens
Oman. Auch in den jüngsten militärischen Handbüchern der USA 103 , Kanadas 104 ,
der Bundesrepublik Deutschland 105 und des Vereinigten Königreichs 106 ist be
stimmt, daß es neutralen Anliegerstaaten einer internationalen Meerenge nicht
gestattet ist, die Durchfahrt von Kriegsschiffen bzw. den Überflug von militäri
schen Luftfahrzeugen der Konfliktparteien auszusetzen oder im Vergleich zu der
Schiff- und Luftfahrt anderer Staaten stärker zu beeinträchtigen. 107 Zudem ist zu
berücksichtigen, daß die Aufrechterhaltung des Rechts auf Transitdurchfahrt
während eines maritimen internationalen bewaffneten Konflikts in besonderem
Maße Sinn und Zweck des Neutralitätsrechts 108 gerecht wird. Zu Recht bemerkt
Rauch daher:
"One of the advantages of . the new transit passage concept is that it
keeps the littoral States bordering straits with great strategic value out
of the vicious circle of escalation in times of tension and crisis. If transit
through such straits were subject to the discretion of the coastal States,
they would unavoidably become involved, even if the discretionary power
were to be exercised evenhandedly, i.e., even if they meticulously abided
by the rule that all restrictions or prohibitions have to be applied impar
tially to the belligerents. The ramifications of a refusal or of a permission
of transit in whole or in part - e.g., only surface navigation, or surface
and submerged navigation, or navigation and overflight - could, albeit
